Lostrac Terms of Service

1. Acceptance of Terms

Welcome to Lostrac ("Platform," "Service," "we," "our," or "us"), India's Most Trusted Lost and Found Network. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Lostrac Networks Private Limited governing your access to and use of the Lostrac website, mobile application, and related services.

By accessing, registering for, or using the Lostrac Platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not accept all of these terms and conditions, you must not access or use the Platform.

2. Eligibility

You must be at least 18 years of age and possess the legal capacity to enter into a binding contract to use the Lostrac Platform. By using the Service, you represent and warrant that you meet these eligibility requirements. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Description of Service

Lostrac is a technology platform that facilitates the reporting, matching, and secure communication between individuals who have lost items and those who have found items. We provide a national network and tools to increase the probability of recovery.

Important: Lostrac is a facilitator, not a party to transactions.

• We do not take custody of any lost or found items.

• We do not guarantee the recovery of any lost item.

• We do not verify the ownership or condition of items listed on the Platform.

• The actual return of an item and any associated arrangements (e.g., meeting, shipping) are solely between the user reporting the loss and the user reporting the find.

4. User Accounts and Responsibilities

4.1. Account Creation: You must provide accurate, current, and complete information during registration and keep your account updated. You are solely responsible for safeguarding your password and for all activities that occur under your account.

4.2. Prohibited Conduct: You agree not to use the Platform to:

• Post false, misleading, or fraudulent information.

• Report an item you know you did not lose or did not find.

• Harm, intimidate, or harass any other user.

• Infringe upon the intellectual property, privacy, or other rights of others.

• Use the Platform for any commercial solicitation, advertising, or spam.

• Reverse engineer, decompile, or attempt to extract the source code of our software.

• Interfere with or disrupt the integrity or performance of the Platform.

• Use any automated system (bot, spider) to access the Platform without our express permission.

4.3. Content You Submit: You retain ownership of the content (descriptions, photos) you submit ("User Content"). By submitting User Content, you grant Lostrac a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and modify that content solely for the purpose of operating and providing the Service (e.g., displaying your lost item listing to other users).

5. The Lost & Found Process: User Obligations

5.1. For Users Reporting a Lost Item:

• You must provide a truthful and detailed description of the item and the circumstances of loss.

• You agree that if your lost item is matched and the finder provides reasonable proof of possession, you will work in good faith to arrange a safe return.

• You are responsible for any reward you choose to offer and for any costs associated with the item's return (e.g., shipping).

5.2. For Users Reporting a Found Item:

• You must make a reasonable effort to locate the rightful owner before or while using Lostrac (e.g., checking local lost property).

• You must provide a truthful and detailed description of the found item.

• You agree to act in good faith to return the item to its verifiable rightful owner.

• You must not demand a reward or payment as a condition for returning the item, unless a reward was explicitly offered by the owner in the listing.

5.3. Safe Reunion Practices: Lostrac provides tools for secure communication. However, all in-person meetings or final return logistics are arranged at the users' own risk. We strongly advise:

• Meeting in safe, public places during daylight hours.

• Bringing a friend or family member.

• Verifying ownership through specific details (e.g., identifying marks, proof of purchase) before handing over the item.

6. Fees

Basic use of the Lostrac Platform—including creating a report, searching the database, and using our secure messaging—is free of charge. We may, at our sole discretion, introduce premium features or services in the future, which will be governed by separate terms and fees.

7. Intellectual Property

The Lostrac Platform, including its design, logo, text, graphics, and software, is owned by or licensed to us and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended personal, non-commercial purpose.

8. Disclaimer of Warranties and Limitation of Liability

8.1. "As Is" Service: THE LOSTRAC PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8.2. Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, LOSTRAC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE PLATFORM.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT OF ONE HUNDRED INDIAN RUPEES (₹100) OR THE AMOUNT YOU HAVE PAID TO LOSTRAC IN THE LAST SIX MONTHS, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless Lostrac and its affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Platform; (b) your violation of these Terms; (c) any User Content you submit; or (d) your interaction with any other user, including any dispute over a lost or found item.

10. Termination

We may, at our sole discretion, suspend or terminate your account and access to the Platform at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. You may terminate your account at any time via your account settings.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in [City, State], India.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
